Terms and conditions

Imray Navigator is designed to provide an introduction to electronic navigation and the use of electronic charts, forming only an aid to navigation. It is not designed to replace printed charts or the navigator’s responsibility to exercise due caution.

Appropriate and up to date paper charts should be carried at all times.

Imray, Laurie, Norie and Wilson Ltd (Imray) disclaim liability to any person for any loss or damage of whatever nature arising from the misuse of this product, or from any event beyond its control including, but not limited to, loss or damaged cuased during installation on the user’s device.

Chart editions

The charts contained in this app are raster images based on the equivalent paper chart.

They are correct to the date of the latest available quarterly update, available to users through subscribing to the Chart Set for a one-month or twelve-month period. New editions, corrections and updates are available at quarterly intervals to subscribers.

Any new version of the app will include all enhancements to the software.

Notice and attributions

The United Kingdom Hydrographic Office (UKHO) and other relevant hydrographic offices make no warranties or representations, express or implied, with respect to this product. Neither the UKHO nor any other hydrographic office have verified the information within this product or quality-assured it.

Application licence

This is a contract between you and Imray, Laurie, Norie and Wilson Ltd (Imray) of Wych House, The Broadway, St Ives, Cambridgeshire, United Kingdom PE27 5BT, and concerns the app and in-app subscriptions you have downloaded consisting of Data, Software and Documentation. By installing the application you accept unconditionally all the terms and conditions of this contract.

1. If you do not agree with the terms and conditions of this contract you should not proceed with the installation of this product.
2. Imray grants you a non-exclusive, non-transferrable, non-assignable licence for the use of this app, to be installed on your own personal device through standard synchronisation methods. This contract is a licensing agreement for the use of the application and not an agreement for sale. Imray continues to own this copy of the app and any other copy that this contract authorises you to make.
3. You are entitled to updates to the application, which are issued from time-to-time by Imray. These updates may contain corrections to the application or additions of content and function, at the discretion of Imray. The terms applying to any such upgrade may vary and will be documented with the upgrade.
4. The licence granted by Imray for the use of the Data, Software and Documentation is conditional upon your agreement to the following:

Use of the application

5. You may use the app at any time and for any purpose, subject to the restrictions in this agreement.
6. You may not copy, rent, sell or transfer the app to any other person or company.

Copyright and the other rights of Imray
7. All the Data, Software and Documentation in this application is Copyright Imray, Laurie, Norie and Wilson Ltd, unless otherwise stated in the app, and is protected by international copyright law. Substantial portions of the app are derived from data which is copyright the UK Hydrographic Office and other Hydrographic Offices. You may not copy, adapt, modify or distribute the Data, Software and Documentation of this app.
8. You grant Imray the right to use any suggestions or comments you may make about the app, without restrictions of any kind, and to own all copyright of any content, design or software that may be based on such suggestions or comments.
9. This agreement does not grant you any intellectual property rights. You warrant your understanding that the Data, the Software and the Documentation are the property of Imray, the British Crown and international Hydrographic Offices and are protected by English law, international treaty provisions and applicable laws of the country in which they are being used. You further warrant your understanding that the structure, organisation and code of the Data, Software and Documentation are the valuable trade secrets and confidential information of Imray.
10. You agree neither to modify, adapt or translate the Data, the Software or the Documentation nor to create any derivative works based upon the Data, the Software or the Documentation. You also agree not to reverse engineer, de-compile, disassemble or otherwise attempt to discover the source code of the Software.

Transfer

11. You may not rent, lease, sublicense or lend the Data, the Software or the Documentation.

Limited warranty

12. Imray warrants that when used with a recommended hardware configuration the Software and latest editions of the Data will perform substantially in accordance with the Documentation.
13. Imray makes no guarantee, representation or warranty as to the performance or reliability of this app. You assume all responsibility and risk for the use of this app. This app shall not be used for any critical or life safety purpose where the application accuracy or performance may result in personal risk or injury.

Disclaimer of warranty

14. Imray disclaims liability to any person for any loss or damage of whatever nature arising from the misuse of this product or rom any event beyond its control including but no limited to loss or damage caused during installation on the user’s device.

15. You assume all responsibility and risk for the use of this product, and assume the entire cost of any necessary fault repair, installation, backup and restore. Imray disclaim all warranties with respect to the Data, Software and Documentation in this Application, including any warranties of fitness for purpose. Imray specifically do not warrant that the Data, Software and Documentation will satisfy your requirements, or that any errors will be corrected within any particular time period.

Limitation of liability

16. Imray shall not be liable for direct, indirect, consequential, punitive or any other damages of any kind. Imray shall not be liable for non performance of the Application or any external systems it may use, such as GPS and others. Imray shall not be liable for your use or inability to use or install the Application.

Governing law and general provisions

17. This contract shall be governed in all respects in accordance with English law and you submit to the exclusive jurisdiction of the English courts and no other jurisdiction. Any dispute arising from this Agreement shall be brought exclusively to a court in England.

18. This contract is the entire agreement between you and Imray relating to the Data the Software and the Documentation and supersedes any prior representations, discussions, undertakings, end user licence agreements, communications or advertising relating to the Data, the Software and the Documentation.

19. If any part of this contract is found void or otherwise unenforceable, that finding shall not operate to affect the validity of the rest of this contract, which shall remain valid and enforceable according to its terms.

20. This contract will terminate automatically upon any failure by you to comply with its terms.

21. The contract may only be varied in accordance with express terms agreed to by an authorised employee of Imray.

Termination

22. You may terminate this Agreement by destroying all copies of the Application that may have been installed in your computer or device. This Agreement will terminate if you breach any of the terms in this Agreement. The User License is revoked when this Agreement is terminated.

About/Privacy policy

Imray Laurie Norie & Wilson Ltd (Imray) is committed to ensuring that your privacy is protected. This policy explains how we use the information we collect about you and the procedures that we have in place to safeguard your privacy whilst you use this Imray Navigator application.
We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998).

The information we collect and how we use it

When you submit requests for help with this app to Imray (support@imray.com), we need to know your name and email address. This information allows us to fulfill your request for help. Imray do not have access to any credit or debit card details.
To assist with technical requests, we may also collect technical information such as the type of mobile device you use, a unique device identifier such as your device’s IMEI/UUID, your mobile operating system, the time zone setting of your device, information about whether you have other Imray apps installed on your device.
We may also ask you to give us additional contact information, for example your mobile telephone number.
If you choose to subscribe, via our website or via support@imray.com, to our mailing lists for marketing material, you may be asked to specify the areas in which you are interested so that we can tailor the information that we send to you to cover the products that we believe you might be interested in.
We do not pass on your personal data to any third party companies.
We may also use your information for the purpose of providing you with information about any special offers, author signings and other events or features of our website which we think may be of interest to you and for related marketing purposes.
By submitting your information you consent to the use of that information as set out in this Policy. If we change our Privacy Policy we will post the changes at www.imray.com and on this page so that you may be aware of them.
The information you provide may be transferred temporarily via a route which takes it outside the European Economic Area as it passes between you and us. By submitting your information you consent to this transfer.

Opt in/opt out

If at any time you wish to receive information about any other product areas which you currently do not receive, you can sign up to our email newsletters by sending a request to support@imray.com. You can opt out of receiving email newsletters in the same way. Security of your information We follow strict security procedures in the storage and disclosure of information that you have given us. This is to prevent unauthorised access or unlawful processing of your personal information.
We keep your information confidential and store it on a secure server which is password protected and hidden behind a firewall. We use secure socket layer software (SSL) to encrypt all of your personal information including name and address. Imray internal procedures cover the storage, access and disclosure of your information.

Non-disclosure to third parties

Unless we have your express consent, we will only disclose your personal data to third parties if this is required for the purpose of completing your transaction with us.
We use your information only as set out in this Policy and will not sell, rent or pass your information on to others for marketing purposes without your express consent.
Imray may however provide aggregate statistics about its customers, sales traffic patterns and related site information to reputable third-party vendors and relevant affiliate partners, but these statistics will include no personally identifying information. We may also release account information where we believe in good faith that this release is reasonably necessary to comply with the law.
